Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Electro Technologies Limited website located at https://electrotech.co.ke and the provision of engineering services by Electro Technologies Limited ("Company", "we", "us", or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website, submitting an enquiry, or entering into a service agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our website or engage our services.

2. Services

Electro Technologies Limited provides professional electrical engineering, structured cabling, ICT infrastructure, security systems, fire alarm systems, audio visual systems, UPS installation, lighting design, and switchboard installation services. All services are subject to a separate written agreement, quotation, or purchase order duly agreed by both parties.

3. Quotations and Pricing

  • All quotations are valid for thirty (30) days from the date of issue unless otherwise stated.
  • Prices are exclusive of applicable taxes (including VAT) unless explicitly stated otherwise.
  • We reserve the right to revise pricing if project specifications change after a quotation has been issued.
  • Acceptance of a quotation must be made in writing by an authorised representative of the client.

4. Payment Terms

  • Payment terms will be specified in the project contract or purchase order.
  • Standard terms are: 30% deposit on contract signing, 40% at midpoint, 30% on completion and handover.
  • We reserve the right to suspend work if payments become overdue by more than fourteen (14) days.
  • Late payments may attract interest at the rate of 2% per month on the outstanding balance.

5. Project Execution

We will carry out all works in accordance with:

  • The agreed scope of work and project specifications.
  • Applicable Kenyan building codes, electrical regulations, and statutory requirements.
  • Relevant international standards including IEC, BS, ANSI/TIA, and NFPA where applicable.
  • The reasonable instructions of the client's authorised representative on site.

The client is responsible for providing safe, unobstructed access to the site and for ensuring that all necessary permissions, approvals, and structural work are in place prior to commencement.

6. Variations

Any changes to the agreed scope of work must be formally agreed in writing before implementation. Variations may affect the contract price and completion schedule. We will issue a variation order for client approval before proceeding with any additional work.

7. Warranties

We warrant that all works will be carried out with reasonable skill and care and in accordance with the agreed specifications. We provide a 12-month defects liability period on completed installation works, during which we will rectify any defects arising from our workmanship at no additional cost. This warranty does not cover:

  • Damage caused by misuse, unauthorised modifications, or third-party interference.
  • Normal wear and tear or consumable items.
  • Defects arising from client-supplied materials or equipment.
  • Damage caused by force majeure events (floods, storms, civil unrest, etc.).

8. Intellectual Property

All designs, engineering drawings, specifications, proposals, and technical documents prepared by Electro Technologies Limited remain our intellectual property unless expressly transferred in writing. The client is granted a licence to use such documents solely for the purpose of the project.

9. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information, technical data, and commercial terms shared in connection with any project. This obligation survives termination of any agreement between the parties.

10. Limitation of Liability

To the fullest extent permitted by applicable law, our aggregate liability arising from or in connection with any project shall not exceed the total contract value of that project. We shall not be liable for any indirect, consequential, special, or punitive damages, including loss of profits, business interruption, or data loss.

11. Termination

Either party may terminate a project agreement by giving thirty (30) days' written notice. In the event of termination, the client shall pay for all work completed to the date of termination, including materials procured or on order and reasonable demobilisation costs.

12. Force Majeure

Neither party shall be liable for delays or failure to perform obligations due to events beyond their reasonable control, including but not limited to acts of God, government actions, natural disasters, pandemics, industrial action, or supply chain disruptions.

13. Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.

14. Website Use

You may use our website for lawful purposes only. You must not:

  • Use the website in any way that breaches applicable laws or regulations.
  • Transmit unsolicited commercial communications (spam).
  • Attempt to gain unauthorised access to any part of our website or systems.
  • Reproduce, redistribute, or commercially exploit any content from our website without prior written consent.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website following any changes constitutes acceptance of the revised Terms.
